Statement by Head of Islamic International Committee for Human Rights & Deputy Secretary General of Union of NGOs

of Islamic World (UNIW)

Lawyer Mr. Mubarak Al-Mutawa issued the following statements:

The public media has broadcasted and published the statement made by the Public Prosecutor of the International Criminal Court (ICC) Mr. Luis Moreno Okambo regarding his non opening the files of the cases filed to him on the issue of Palestine and the repeated Israeli attacks against Gaza strip.

Whereas the Committee and a number of NGOs were disappointed and annoyed by this statement because it comes within the equivocation, procrastinations and false justifications continuously repeated by the Public Prosecutor and utilized them as an excuse for not assuming his obligations under the ICC Law. By reference to the Articles 12, 13, & 15 of the ICC statute, especially paragraph (1) of Article (15), it gives him the right but also hold him expressly committed, legally & morally, to initiate the investigation and then presents the matter to the ICC as per paragraphs 3 & 4 of the same Article immediately he becomes aware of the matter, i.e. this case falls within the jurisdiction of the ICC under its articles.

In addition to that, this information has been mentioned in several  complaints by individuals and NGOs as a result of the repeated attacks against Gaza, West Bank and Southern Lebanon.

Nevertheless, the Public Prosecutor remained unmoved. These days he appears before the entire world and alleges that he cannot activate or open the investigation in this case unless the United Nations Organization admits & recognizes Palestine as a State.

This statement contradicts the provision of the ICC statute as well as the Public Prosecutor’s jurisdictions which he has utilized more than once in international cases. By doing this, the Public Prosecutor is converting the ICC into a political body for serving political purposes & beliefs as if he would like to close the door before he quits his office. Thus, he wants to pave the way for his successor and follows only what he decided, although he is aware that this is   incorrect and violates the law & the general rules.

Therefore, during the remaining period of his term or even that of his successor, we will do our best to demand them to set this action in motion and open the investigations, otherwise, the statute allows for referring the matter to the ICC itself to hold the Public Prosecutor accountable because the position of Mr. Okambo is not binding to his successor.

Accordingly, if he does not rectify his position within days, we will be forced to refer the matter to the ICC and present the Prosecutor’s position to it under the ICC statute. Hence, we here by all upon all NGOs and all activists in the field of human rights to consolidate with us in this regard and to file their stand before the ICC and  the Public Prosecutor’s office in The Hague.

أدلى الأستاذ المحامي / مبارك المطوع بالبيان التالي :
بثت ونشرت وسائل الإعلام التصريح الذي أدلى به مدعي عام المحكمة الجنائية الدولية السيد / مورينو اكومبو بخصوص عدم تحريكه أو فتح ملفات القضايا والتي وردت إليه وقدمت بخصوص فلسطين والاعتداءات الإسرائيلية المتكررة على قطاع غزة .
وحيث أن اللجنة وعدد من المنظمات الأهلية ومؤسسات المجتمع المدني قد ساءها وأصيبت بخيبة الأمل والانزعاج مما ورد في هذا التصريح لأنه يأتي في سياق المغالطات والتبريرات التي كان يرددها دائما ويتعذر فيها بغير حق عن عدم قيامه بواجبه والتزاماته بموجب القانون الخاص بالمحكمة وأنه بالرجوع إلى المواد 12 ـ 13 و 15 وبالاخص الفقرة 1 من المادة (15) التي يعطيه الحق بل تحمله الالتزام الواضح قانونيا وأدبيا أن يفتح التحقيق ومن ثم يعرض الأمر على المحكمة وفق الفقرة 3 ـ 4 من المادة ذاتها وبمجرد أن ترد إليه ويصل لعلمه أي أنها تدخل في اختصاص المحكمة بموجب موادها الأولوية ..
فضلا عن ورود هذه المعلومات بموجب شكاوي عديدة من الأفراد ومنظمات المجتمع المدني أثر الاعتداءات المتكررة على قطاع غزة والضفة وجنوب لبنان .

ومع ذلك نجده لم يحرك ساكنا ويأتي علينا وأمام العالم ليدعي أنه لا يمكن أن يحرك الدعوى أو يفتح التحقيق إلا إذا اعترفت الأمم المتحدة بفلسطين كدولة .
مناقضا بذلك نصوص قانون المحكمة وماله من صلاحيات استعملها أكثر من مرة في قضايا دولية مما جعله يحول المحكمة إلى محفل سياسي ولإغراض وقناعات سياسته وحسب وكأنه أراد أن يغلق الباب قبل أن يترك مكانه وكان يريد أن يرسم الطريق لمن بعده أن لا يفعل سوى ما قرره هو رغم علمه بأن ذلك غير صحيح ومخالف للقانون والقواعد العامة ولذلك سنعمل خلال ما بقي من مدته أو في عهد من يليه لمطالبتهم في تحريك الدعوى وفتح الملفات وإلا فإن النظام يسمح لرفع الأمر للمحكمة ذاتها لمحاسبة المدعي العام كما أن موقف السيد أكومبو ليس ملزما لغيره ومن بعده .
وأن لم يصحح الموقف وخلال أيام سنكون مضطرين لرفع الأمر للمحكمة وعرض تصرف المدعي العام عليها بموجب قانون المحكمة وندعو المنظمات والجمعيات الأهلية وكافة الناشطين في حقوق الإنسان والمجتمع المدني للتضامن معنا في هذا الشأن وتسجيل موقفهم لدى المحكمة ومكتب المدعي العام في لاهاي .

الوضع بين الطرفين :

ثائر مندفع ويتوجه لأهدافه مدفوعا بأسبابه وقائد متمسك بموقعه الذي حازه سنوات طوال غير مسلم بما يجري وما يطلب مجددا بمساندة من العاملين معه و المؤازرين له.

وعلى أرض الواقع أنقسم الوطن إلى قسمين : 1 ـ شرقي و 2 ـ    غربي تماما كما انقسم الشعب إلى قسمين :

1- مع الثائرين ومتطلعين للتغيير ولعهد جديد .

2- مع القائمين على الحكم وشئون الحكم بصورته السابقة عبر سنين

ويبدو أن لا رجعة لأي من الطرفين عن موققه ، لأن في التراجع خطر على أي منهما من الأخر.

ولا بد من ضمانة هذه المسألة في حال تفوق أي طرف على الأخر وانتصار في عملية كسر العظم التي وصل إليها الوضع .

والخشية كل الخشية أن يستمر الاثنان في المواجهة لأمد طويل لأن الأمر بات واضحا أنه سيكلف أرواحا وأموالا وجراحا وأمن وسمعة واقتصاد وآثار دولية ومحلية من أسوأ وأعنف وأقسى ما يمكن تصوره سيما وأن أحد الطرفين يملك من القوة المادية والسلاح ما يجعله خطر محدق وفادح على الطرف الآخر حتى ولو تفوق الأخر عليه بالعدد فهو صراع فية العدة والعتاد والعدد والاستعداد ،

فلا بد إذا على عقلاء العالم والوطن أن لايبقوا صامتين متفرجين بعد أن شاهدنا الأحداث واستمعنا لخطب ومؤتمرات صحفية ولقاءات إعلامية وتصريحات متلاحقة من الطرفين.

ووجدنا أنفسنا أمام هذا الصراع والمواجهة والاختلاف الذي سيدمر الوطن ويحرق الأخضر واليابس ويقضي على الحرث والنسل.

وثمة ما قيل وسمعنا ما يمكن ان يعتبر إنطلاقا إلى العهد المنشود والمطلوب لكنه يأتي  في سياق الترهيب والترغيب أو يأخذ شكل التهديد والوعيد من  الطرف الذي يملك القوة الضاربة في حين يعتبره الطرف الأخر بداية النهاية أو فقدان كل شيئ ونرى في ذلك ما يشجعه على الاستمرار في مطالبة واعمالة مهما كلفه ذلك أكثر مما كلف .

وهذا أمر ووضع لا يمكن الرضا به أو السكوت عليه حتى تقع الطامةالكبرى وتدمر الدوله وتستمر المواجهة التي يخشى منها ولا يتمناها أحد لما يعلم مسبقا ما سوف تسببه وتتركه وراءها من أثار ولا نجد حاجة لذكرها ووصفها أو حتى توقعها .. فما هو المنطق واين صوت العقل والحكمة هنا ؟؟

فما هو الموقف الذي يبنغي الأن انجازة لكي نحافظ على الأرواح والأبرياء والثروات والأمن والسلم ويحقق شيء من الاعتدال والتوازن في مطالبة وما يصبو إليه ابناء الوطن الواحد. ويحفظ  لكل طرف حقوقة .

فهل يقبل الشعب الليبي والطرفان المنقسمان المتواجهان الوقوف عند منطقة مشتركة و حل وسط أو نقطة لقاء لمدة مؤقتة محدودة ولا شك أن هذا يعتمد على تقدير كل طرف لمواقفه واستعداده للمواجهة والتضحية التي يترتب عليها ذلك

وهنا ما علينا إلا أن نعرض ونقترح من قلوب ناصحة محبة لامتها وبلادها وأوطانها وشعوبها مخلصة لقضايا الأمة ومنطلقة من واقع ما أمرنا الله إلا بقولة :

” وَإِنْ طَائِفَتَانِ مِنَ الْمُؤْمِنِينَ اقْتَتَلُوا فَأَصْلِحُوا بَيْنَهُمَا فَإِنْ بَغَتْ إِحْدَاهُمَا عَلَى الأُخْرَى فَقَاتِلُوا الَّتِي تَبْغِي حَتَّى تَفِيءَ إِلَى أَمْرِ اللَّهِ فَإِنْ فَاءَتْ فَأَصْلِحُوا بَيْنَهُمَا بِالْعَدْلِ وَأَقْسِطُوا إِنَّ اللَّهَ يُحِبُّ الْمُقْسِطِينَ “

الآية 9 سورة الحجرات

وقولة سبحانة {إِنَّمَا الْمُؤْمِنُونَ إِخْوَةٌ فَأَصْلِحُوا بَيْنَ أَخَوَيْكُمْ وَاتَّقُوا اللَّهَ لَعَلَّكُمْ تُرْحَمُونَ}

ولا يمكن ذلك بغير قبول من الطرفين لجهة تكون لها كلمة مسموعة وحكما مقبولا من الطرين وبداية يجب أن يكون الحكم أو الرأي المسموع هذا في حدود مصلحة الشعب والوطن وحقن دمائه وتحقيق ما يصبو إليه مع الحفاظ ما يستوجب من تعامل لائق ولكن ذلك لا يمكن أن يقبله طرف من الآخر مالم يتدخل طرف ثالث مفوض وموثق ومقبول من الطرفين وتكون له الكلمة و الصلاحية وهذا ماأقترحه .

بقبول تشكيل مجلس يسمى المجلس المحكم ـ أرجوا الانتباة ـ وليس الحكم لانه سيكون مفوض من الشعب بطرفيه المتنازعين أو جهتيه….الصراع.. على أن يمثل فيه الطرفين بعدد محدد ومتساوي لكل منهما ومن غيرهم من خارج البلاد ومن شخصيات دولية ذات بعد عالمي معروفة بحكمتها وخبرتها واقترح أن يكون خمسة عشر من الأعضاء ـ 7 سبعة منهم من خارج الوطن ومنهم يختار رئيس المجلس المؤقت و 8 ثمانية أشخاص آخرين من الوطن أربع لكل طرف وعليه أن يضمن القيام بالوعود والمطالب باسلوب عملي وإليه يرسمها ويحفظ لكل الأطراف مراكزهم حفاظا على سلامة الوطن ووحدته ويعيد ترتيب الأوضاع مع احترام المراكز لاشخاص الأطراف وفق إجراءات وآلية عمل محددة يتفق عليها ولمدة ستة أشهر تمدد لفترة أخرى عن اللزوم وفقا لما يلي.

1- تشكيل مجلس (تحكيم) لادارة مؤقتة للبلاد . وليس حاكم بل للادارة المؤقتة

من الليبيين 8 (أكثريه) حال اتفاقهم / أربع من كل طرف 4 + 4 ومن غيرهم (دوليين) بعدد أقل 7 مرشحين وفي الجانب الليبي من يمثل الشعب المجموع خمسة عشر.

ويقترح ترشيح الحكماء الدولين من امناء المنظمات الدولية الحالين او السايقين و الخبراء الدولين و القانونين من المحامين و المستشارين و القضاة مثلا.

2- يكلف بموافقة الشعب و مباركتة بإدارة شئون البلاد المجلس الرئاسي و لوضع السياسات العامة والتكاليف يحل محل القيادة الحالية في البلاد ويساندة مجالس تنفيذية يقوم بتشكيلها .

3- يتم إعلان قبول القيادات له وعن الصلاحيات والأحالة إليه ، ولمدة سنة و 6 شهر فقط تمدد لفترة أخرى مماثلة واحدة فقط ونهائية .

4- يختار من بينه رئيسا للمجلس من الدوليين في الفترة الأولى فقط وفي حال التمديد لفترة أخرى يكون الرئيس من الليبيين حال اتفاق المجلس على ذلك.

أ‌- يكون من واجبه المحافظة على الأرواح والأمن والسلم وإنهاء حالة النزاع .

ب ـ     المحافظة على الاقتصاد المكتسبات الشعبية والوطنية والأموال العامة والممتلكات الخاصة .

ج ـ     حل النزاعات والتخلص من حالة الفوضى .

إعادة العدل والاستقرار وإرساء الحقوق الاجتماعية والمدنية والسياسية .

د ـ      تعويض المتضررين ويقدر دور كل من عمل من الطرفين ويسعى للعفو عن الأخر .

ه ـ      يضع الأسس والقوانين الرئيسية والأساسية للعمل بها في المرحلة الانتقالية وعرضها على المجلس النيابي المنتخب لاقرارها او اعادة النظر فيها .

و ـ      يشكل لجنة لإعداد الدستور ويدعو إلى جمعية تأسيسية لإقراره الانتخابات الحرة يدعو لانتخابات عامة ـ برلمانية  ورئاسة وفق برنامج محدد.

زـ       يشكل مجلس حكماء ومستشارين من الوجهاء والزعماء الليبيين ويشارك معهم من كان له دور و طني في الماضي و الحاضر بعد مصالحة شاملة بين كافة الاطراف وتناسي جراح الماضي و النزاع القائم يكون نواة و تمهيدا لمجلس الشيوخ و الشورى في مرحلة قادمة.

مع حفظ الحقوق الشخصية قبل الدولة و النظام العام و التجاوز عن الاشخاص و بداية صفحة جديدة في ظل وطن أمن تسودة المبادئ العادلة و قواعد القانون كما تجمعة بين كافة افرادة …. روح المودة و التفاهم و حب الوطن والواحد والله الموفق

و الله  من وراء القصد و هو المستعان.

APPROACH FOR SOLVING THE PROBLEM AND FINALIZING THE CURRENT DISPUTE IN LIBYA

The current situation between the two parties:

Dashing revolutionists who are  going towards achieving their goals driven by their reasons; and a leader who adheres to his position which he has occupied for long years, not agreed with what is going on and what is demanded aided by his supporters?

In reality, the country is now divided into two parts: 1) Eastern, 2) Western, just as the peoples divided into two parts:

1.       Some support the revolutionists and look forward to change and a new era.

2.       Others support the rulers who manage the ruling affairs in the previous method that lasted for many years.

It seems that no party is willing to retreat from its stand because this will result in dangerous consequences by either party towards the other.

Hence, this issue should be solved under certain guarantees if either party achieves victory in the current crucial situation.

However, we are afraid that both parties continue the existing confrontation for a long period of time because it is now obvious that this hostile situation will result in the wasting of lives and property besides the injuries, lack of security, affected reputation, destroyed economy, local and international worse consequences which had not ever happened or even be expected, especially that one of the two parties holds a strong power and destructive weapons which will make it constitute a devastating danger to the other party even if the latter can prevail in terms of numbers. So, this conflict is involves heavy arms and machinery supplies and large numbers and preparedness.

Therefore, the wise men in the nation and the world should not remain silent and unmoved just like the spectators after they have watched the violent incidents and heard the speeches, press conferences and frequent press releases issued by both parties. And thus, we found ourselves in such a conflict and confrontation which will destroy the country and burn out everything, the people and property.

But, all the sayings we have heard and the speeches being circulated nowadays about a new intended era come within the context of threads, stick and carrot policy, or sometimes takes the form of threads and bad consequences from the party who has powerful force whereas the other party views it as the beginning of the end of the other party who is seamed to them lost everything, and this will encourage the revolutionary party to proceed on with its revolution and try to achieve its demands, whatever the consequences may be.

In  this context, we cannot keep silent towards these incidents until we see the catastrophe takes place which will destroy the state and the confrontation will continue and will finally result in devastative consequences which no one can describe or even anticipate. So, where is logic and what is the voice of truth, mind and wisdom in this situation?

And what is the right stand and position which should be achieved now in order to save the lives of innocent people, resources and maintain peace and security in such a way which shall realize some kind of moderation and balance in the demands and thus to achieve the final goals intended by the people of one unified nation, in such a manner that should reserve the rights for people from each party?

Do the people of Libya and the two parties of the dispute accept to come to a middle point and a compromise solution for a specific temporary period? No doubt that this depends on the discretion of every party, its assessment to its position, and its readiness for bearing the sacrifice in order to achieve this goal.

Here, at our part, we will just propose and suggest through pure and honest advice from such people who love their nation, countries and peoples who are loyal to the issues of the nation, and just driven by the orders of Almighty Allah who says:

“And if two parties of believers fall to fighting, then make peace between them. And if one party of them doth wrong to the other, fight ye that which doth wrong till it return unto the ordinance of Allah; then, it return, make peace between them justly, and act equitably. Lo! Allah loveth the equitable”. Al-Hugrat, Verse (9)

Also, Allah says:

“The believers are naught else than brothers. Therefore make peace between your brethren and observe your duty to Allah that haply ye may obtain mercy”.

Hence, this cannot be realized without the acceptance of both parties in front of such an entity which shall have a respected word and an acceptable judgment to both parties. In the beginning, this judgment or acceptable opinion for the interest of the people and the country in order to stop the blood shed and achieve the intended goals within the method of good and decent dealing and treatment. However, this will not be acceptable by either party from the other unless a third authorized, trustful and acceptable party for both parties interferes in this conflict and which shall have the respectable world and authority.

Consequently, I propose the following:-

*        The parties have to accept the formation of a council to be called the Control & Mediation Council – and not rulers Council – because this council will be authorized by the people represented by the two parties of the dispute, provided that the parties shall be represented in this council by a specific and equal number from each party in addition to other persons from outside the country consisting of international persons with world acceptance and well known of their wisdom and experience. I suggest this council to be formed of fifteen (15) members, of whom (7) from abroad and among whom there shall be elected the chairman of the council and other eight (8) persons from inside the country, four from each party. The council shall ensure the satisfaction of promises and demands in a practical way, and it shall also set forth these demands and promises, and it shall reserve the positions of all parties in order to maintain the safety, unity and integrity of the country, and it shall re-arrange the situation pursuant to a fixed working mechanism and procedures to be agreed upon for a period of six months to be extendible to another term, if necessary, as per the following manner:-

1. The formation of an Control Council for managing the country temporarily. This council is not a ruling council but for the temporary administration. The council is to be formed from eight (8) Libyans (the majority) to represent the people – if they agree – four from each party (4+4) and from other (international) persons consisting of seven (7) nominees. So, the total number is fifteen (15) members.

We propose that the international governors to be nominated from among the current or former general secretaries and chairmen of international organizations and also from international experts, legal advisors, lawyers, consultants and judges.

1. This council shall be entrusted, upon the approval of the people, to run the affairs of the country, sets the general policies and authorities. This council shall replace the current situation  in the country and it shall be aided by executive councils to be formed by the council.

1. The leadership of two parties shall declare its acceptance of this council as well as its jurisdictions and the matters to be referred to it. This council shall last for one year and six months only to be extendible for another similar and final one period only unless it needs more time.

1. The council shall elect from among its members a chairman from the international persons during the first term, and in the event of renewal for another period, the chairman can be selected from among the Libyans if the Council decides so.

1. Among the duties of the Council is:

a)       To save the lives of the people and to maintain security and peace     and to finalize the dispute.

b)                To maintain the economy, popular and national resources, public funds and property.

c)                 Solution of disputes and avoiding the status of chaos

d)                To restore justice and stability and to enhance the political, social and civil rights.

e)                 To compensate the people who incurred damages and to appreciate the role of both parties who shall to forgive each other.

f)                  The council shall set forth the main foundations, basic laws and applicable laws to be adopted in the transitional period and to present the same to the council of parliament representatives to be elected by the people in order to adopt or reconsider these laws.

g)                 A committee shall be formed to prepare the draft of constitution and it shall invite for a constituent assembly to approve it after the free general elections (parliamentary and presidential) according to a specific program.

h)                A council of consultancies and advisors shall be formed from the Libyan key and influential persons and to be participated by those who have played a national role in the past and in the present after making a comprehensive reconciliation between all parties who shall forget the grievances of the past and the existing dispute this council will be as a base and preparatory for the senate council and consultative council if needed in future.

This is together with reserving the personal rights by the State and the public order besides the forgiveness of all persons by opening a new chapter within a one and unified homeland where the principles of equity, justice and law shall prevail among all the individuals of the community in a spirit of mutual love and understanding and the love of a one united country.

These are our honest intention and look forward to the kind assistance of ALLAH

لكننا لم نسمع منكم في حينها اي رد او تعليق او كلمى حلوة رغم ما تحمل قلوبنا لكم من حب و اننا امة واحدة
ونعيد ارسالة اليوم ( بعد عام الثورة) فهل تصل قلوبكم و اذهانكم ؟

سؤال نطرحة بكل أمانة وبراءة :- هل الشعب المصري صدق وصدق أم خدع وانخدع ولنقرر بداية وقد ثبت ان سياسة الدول والحكومات الحديثة في معظمها الا ما رحم ربي منذ ظهرت او استلمت زمام الحكم في النظم المعاصرة تقوم على الخديعة و الكذب و الرياء و الافتراء والظلم والقهر والاستبداد والفساد وكافة المصطلحات السيئة في قاموس السوء يمكن ان تستخدمها. تحت ما يعتبرونة السياسة.
فلا تعمل خيرا او نفعا الا بمايتصل بحماية وجودها او قيامها او استمرارها جاثمة على صدور العالمين من محاباة لقواتها و عناصرها وتنفيع لمن هو معها فقط ومن يتحزب في حزبها هؤلاء فقط المستفيديون و المنتفعون ولانهم مهما بلغوا لن يكونوا الشعب كله
لذلك سيبقى معظم الشعب في الجهة الاخرى التي تتجرع ويلات الأنظمة ومصطلحات السوء والفساد والتي اسلفنا ذكر بعضها وتركنا لك ان تتصور الباقي.
فهذا الشعب والاكثرية ممن لا ينتفع او يستفيد من النظام وفساده لايمكن ان يشكلوا حكما رغم انهم الاغلبية ولكن الأقلية تمكنوا منهم و يمكنهم ان يتحكموا بالاغلبية الصامتة المتابعة او المنخدعة باساليب النظام ودعايتة واعلامه وابواقة ومنهم من هو خائف من بطش النظام و سطوتة و اساليب اذلالة للشعب ومنهم من رضي و استكان وسلم لأمر الله .
ولكن يبدو ان كل ذلك الى حين والى لحظة انفجار كانت تنتظر شرارة من هنا او هناك وربما جاءت هذة المرة من تونس أوقدها حريق في جسد شاب أشعل النار بنفسة بعد ان اعيتة الحيلة و الوسيلة .

هكذا اذا كانت البداية وانطلاقة الشرارة حتى ولدت غضبا يتلوه غضب و ارادة تستجمع الارادة ودماء و شهداء وأرواح طاهرة بريئة و نفوس زكية على طريق النصر ونيل العزة و الكرامة الحقيقي لا الصورية و الاعلامية المزيفة طوال السنين الماضية.

وكان ماكان و الكل يعرفه و حصل ما حصل والكل تابعة وعاشة لحظة بلحظة
وتحقق ما تحقق و الكل أدركة سمعة وتتزايد التحفظات و التساؤولات مع مرور الوقت و صدور البيانات وكان شيئا خفيا يجرى او رهان على الوقت و الهدوء أو شيئ في الطريق والمجهول قادم فلا يمكن ان نؤكد ونقطع بأن الكل مطمئن أو آمن على نفسه أو ثورته أو غضبه أو مستقبله و حقيقة لا يدري ماذا ينتظره
فلذلك الثورة لم تخمد بعد و تجدها تتجدد من جمعة إلى جمعة فمازالوا يطلبون ايضاحا وتوضيحا …. أو يطلبون جدولا زمنيا ومنهم من يريد خارطة واضحة للطريق كل ذلك تحت وقع وتأثير المسكنات و المهدئات و البيانات المتلاحقة.
فما وجد منها غير تعطيل أو إبدال وجه بآخر من نفس النوع واللون والجنس كما سمع الشعب التطمين تلو التطمين للخارج قبل الداخل لأولئك الذين لم يناموا لياليهم منذ الثورة ولم يعرفوا طعم الراحة عند انتصارها إلا بعد تطمين المجلس الأعلى الحاكم أنهم ملتزمون بالمعاهدات معهم وسوف تستمر الحماية المقررة لهم بالمعاهدات كما كانت فأرقدوا قريري العين .. وتكرر هذا التطمين وكأنه من الأولويات القصوى التي اندلعت الثورة من أجلها .
ألم يكن من الأولى تضميد جراح الجرحى والمكلومين ومواساة أهل الضحايا والشهداء أم كانت التحية العسكرية في البيان العسكري كافية لدفن هؤلاء الشهداء بلا رجعة او محاسبة ومحاكمة لمن قتلهم وللأبد ؟ ا

أما كان من الأولى فتح التحقيق الفوري في اسباب قتلهم ومن وراءه أم أن الأنشغال والانتقال إلى شكر الرئيس محمد حسني مبارك في ذات البيان بعد تحية الشهداء كان أولى وأهم ليطوي صفحة لا يمكن طيها إلا بتحقيق العدالة. فهل من العدالة أن ينال الشكر على ما قدم سلما وحربا بلا سؤال أو جواب وكيف يمكن الملاحقة القانونية بعد هذا البيان له أو لمن قام مقامه وعمل بعمله وسياسته وأؤتمر بأمره حتى وصل الأمر إلى قتل الأبرياء بالمئات وجرح الألاف وقد شاهدنا ذلك عيانا وأصبح العالم كله شاهد على القتل بالرصاص الحي و الضرب والدهس المتعمد العشوائي .
كل شيئ يراد له أن يكون عشوائي الإنسان و الحياة والعيش والشعور والكرامة الحقيقية والعدل والأمن والمال والاقتصاد و الكلمة والصدق حتى السكن أصبح يسمى بالعشوائيات , راجع راقب إرجع بذاكرتك تجدهم اوصلوا الإنسان المصري الأبي الكريم المعروف على مر الزمان أنه القائد الرائد والماجد في أمته الذي علم الدنيا من أزهره وجامعاته وصدر العلم والعلماء للخارج والعالم بأسره تجدة اليوم يعيش كبيره وصغيره بشكل عشوائي ا فهــل يعقـــل ؟
فلا عجب أن تقوم الثورة ، لكن العجب أن يراد لها أن تكون أيضا ثورة عشوائية لشعب عشوائي وحدث عابر لا يغير من الأمر كثيرا .
فهي مجرد استبدال وجوه واستبدال نصوص .. هكذا نكون أمام مصيبة وطامة كبرى لقتل هذا الوليد القادم للحياة بكل قوة وبراءة وأمان إلى ما آلت اليه الحال وهو في مهده بعد مخاضه العسير حتى ولدت هذه الثورة و ظهرت للحياة ورأت النور .

وهي تنتظر إلى أن تتقدم بخطواتها إلى مستقبل مشرق واعد أفضل وهذا ما أرادت .. لا أن تولد فتموت في مهدها ..
ولا شك أن من عارضها وقاومها وقتل أبنائها ويتم أسرها وسرق مقدرات الشعب قبلها ومارس البغي والطغيان عل الناس من كافة الفئات هو ذاته ومن كان معه هو من يعمل على وأد الوليد في مهده .
فهذا لا يهمه تغيير الوجوه والأشخاص لكنه يهمه بقاء السياسات والأجندة التي كان يعمل بها ويجتهد في تحقيقها ويحيى حياته من أجلها فإن أستلمها غيره فهذا حظه ونصيبه في الحياة بعد أن انتهى دوره فيها وقد أمضى من العمر اضعاف ماكان يأمله ويؤمله المهم أن تبقى سياساته وأجندته .
والتي على رأس أولوياتهم أن يطمئن من كان يعمل من أجلهم ولحسابهم وكانوا السبب في وجوده واستمرارة وبقائه طوال هذه السنين جاثما على صدر شعبه المهم أنه يحقق لهم ما أرادوه وما يطلبوه منه ومهما تلونوا وظهروا بمظهر الشفيق المحب للشعب والديمقراطية فكل شيئ معروف ومفضوح وكما قال أحدهم فهؤلاء يكذبون كما يتنفسون الهواء .
فهل ينطلي ذلك على الشعب المصري والثوار من الشباب والشعب والرجال والنساء ، هل يا ترى أنهم يشعرون بأنهم صدقوا فصدقوا فيصدق الوعد هل من بينهم من يستطع أن يقرأ السطور وما بينها ويقرا الوجوه والحركات ويقرأ التاريخ والمستقبل هذا النوع من الناس حق له أن يقود وأن يقول فيسمع ولكن عليه أولا أن يضحى ويصدع بالحق ويقرع الأجراس ويعلوا المآذن من جديد .
وما يوم الجمعة ببعيد فمن حق الشعب أن يتساءل من جديد هل صدق وصدق أما أنه أنه خدع فإنخدع أم انه قادر على الحفاظ على منجزاته وثورته ليحدد من جديد طلباته لهذه المرحلة ويحدد قيادته ومن يمثله وربما قد فاته ذلك وهو في فورة غضبه واندفاعه وغليانة فإذا رأى استجابة صادقة لطلباته فثورتة الوليدة في أمان وان لقى تعنتا وتسويفا فمن حقه أن يخشى على نفسه ومستقبله فلو جعل الجمعة لطلب الصدق والمصداقية وتحديد المسار نحو المستقبل المراد ليعلم الشعب أن كان صدق وصدق أم خدع وانخدع وليعرف واجبة و مصيرة ليعلم العالم كله أن الثورات لا تموت ..

في خطوة انسانية ومن منطلق الشعور بالمسؤولية العربية والاسلامية اتجاه مصر اعلن المحامي مبارك سعدون المطوع نائب رئيس اتحاد الجمعيات الاهلية بالعالم الاسلامي ورئيس اللجنة الاسلامية العالمية لحقوق الانسان التبرع بنصيبه من المنحة لأبناء مصر من الشهداء والجرحى اثناء المواجهات الاخيرة في مصر.
واكد المطوع ان هذه خطوة انسانية واسلامية لاخواننا المصريين للوقوف بجوارهم في محنتهم.
وارسل المطوع خطابا الى شيخ الازهر الدكتور الطيب يطالبه فيه بانشاء صندوق شعبي لجمع التبرعات النقدية والعينية على مستوى كل الاقطار والشعوب العربية والاسلامية وتنطلق كبداية من الكويت التي تستعد لمناسبات وطنية تبرز فيها فرص للعطاء والمساهمات الانسانية والوطنية مطالبا بيت الزكاة الكويتي الذي له فرع في مصر بالتعاون مع هذا الصندوق الشعبي المقترح لإيصال التبرعات لمستحقيها.
وطالب المطوع رجال الاعمال الكويتيين والاثرياء والقادرين للوقوف بجوار اخوانهم المصريين في محنتهم والتبرع بالمكرمة الاميرية او بجزء منها كواجب انساني وعربي واسلامي تلك الرابطة القوية التي تربطنا بهم كما طالب المطوع جميع الشعوب والاقطار العربية والاسلامية ان تدعم الشعب المصري في محنته مؤكدا لهم ان مصر قلب الامة الذي يجب ان تحافظ على قوته ليكون نبعاً للعطاء لأمته مستقبلا.
ودعا المطوع الله عز وجل ان ينعم على مصر واهلها بنعمة الامن والامان وان يجعلها مستقرة، ففي استقرارها استقرار للأمة بأسرها، وان تمر هذه المحنة على خير.

الله يعلم والدنيا تشهد إنك يامصر وشعبها في قلب الأمة وحبك يجري في دمها بل أنت قلبها وقد تسارع الخفقان وتصاعد بالقلب فالتهب جسد الأمة من حر لهيبك .

لقد شلت الأبدان .. واشرأبت الأعناق وتحجرت المقل وهي تراقب هواك وأنت هوانا .

فإن تسكني يامصر نسكن وأن تتوجعي نتوجع وأن دق قلبك وجد نبضه بعروقنا وصداه في دمانا .

فمن جسد الأمة الواحد .. من الكويت .. أوجه هذا ا لنداء ..

فاني مدرك ومتابع ومتألم لآلامك يا مصر ـ وامل بامالك وقد عشنا معك وفيك حتى عشت فينا وأمسينا كل يوم ننتظر فرجا عاجلا لما ألت اليه الأمور وساءت الأحوال (ولن أحتمل ألما اشد مما  تألمت) وقد بات الشد بين أطرافك يمزق أوصالك فيمزق وصلنا ويذهب ريحنا وريحك .

فلا أقل أن أقدم ندائي لك ولشعبك فأما أن يقبل فنصل بكل طرف إلى مراده ومبتغاه ويفرح بذلك البلاد والعباد وكفى الله المؤمنين القتال  .

وأما أن يفتح الله عليكم بخير منه فتتوصلوا للأفضل بفضل الله فيكون ماعرضته عليكم خالصا لله والأمة حق وواجب أديته ولا أدري إن كان آخر العهد بكم أم أنه عهد جديد معكم .

بين الرجوع واللا رجعة :

فمنذ 25/1/2011 توالت الأحداث في مصر وتصاعدت حتى أصبحنا بين فريقين لتيارين أحدهما شعبي ثوري له مطالب يتخذ من التظاهر والتجمع وسيلة وآخر رسمي يستند على الاوضاع الرسميه السابقة للاحداث و تطورها و ماتلاها حتى اليوم، يطالب الشعب يصر بالرجوع أو التراجع ويصمد على استمراره ووجوده وصلاحياته مما يزيد الفريق الأول إصرارا على مطالبه وحركته فينعكس على استقرار وأمان ونماء ورخاء الوطن ومن ثمة الأمة بأسرها لأنها مصر الأمة.

ما المخرج:

فلابد من مخرج .. بالتوافق على التنازل لرئاسة رمزية ومشاركة هيئة استشارية شعبية .

بداية يجب أن تفرز هذه الجموع المتظاهرة وتشكل مجموعة قيادية تمثلهم وتوصل مطالبهم من كافة الأطياف والمشاركين وبالأخص الشباب و الشيوخ والحكماء .

(خطاب التنازل ) ميثاقا شعبيا وعهده رئاسية .

بهذة المجموعة يتم التوافق على يتم التوافق على تشكيل الهيئة الاستشارية العليا او مجلس استشاري معاون للرئيس على ان تتخذ قراراته بالاجماع ولتكن كجزء من رئاسة الجمهورية لتمثيل الشعب الثائر في ابرام عهد وميثاق مع الرئيس ينزل فيه الجميع لمصلحة الوطن والشعب عن سقف مطالبهم للفترة الانتقالية وبعد أن يتأكدوا من تحقيق مطالبهم بهذه  العهدة الرئاسية الشعبية والميثاق الوطني ـ لمستقبل مصر والأمة معها على أن أبرز و أهم ما يتضمنه و يتفق علية :

1 ـ    بمجرد التوقيع يصدر الرئيس بالتزامن معه قرارات بحل مجلسي الشعب والشوري ويدعو لانتخابات جديدة بمواعيد محددة خلال شهر وفق جدول زمني باشراف وطني و دولي و توسعة دور القضاء في فرز النتائج لاقصى قدر ممكن .

2 ـ    يعاد تشكيل الوزارة على أن تكون من المدنيين في غالبها ممن تقترحهم الهيئة الاستشارية .

3 ـ    يبقى الرئيس في منصبه للمدة المتبقية من ولايته ملتزما برأي المجلس الاستشاري الأعلى  متعاونا معه العمل بما يتفق عليه في الميثاق الشعبي والعهدة الرئاسية

4 ـ    يتعهد و يؤمن يؤمن الشعب المصري بمن يمثله في المرحلة الانتقالية وما بعدها تسليما آمنا للسلطة وتقاعداً واعتزالا لائقا بالرئيس مع المراعاه و الاحترام لمكانتة واعتباره لسنين خلت و حفظ سلامتة و ممتلكاتة الخاصة وحق استخدامة للعامة الى حين انتهاء رئاستة .

5 ـ    يستثنى مما سبق ما يحكم به القضاء مما يكون ملكية عامة أو ملكا خالصا للشعب قد يكون ألت اليه و ثبت انه بطريقة غير مستحقة او مشروعه.

6 ـ    يعاد تسمية وتعين نائب رئيس الجمهورية أخر من الشعب ممن يقترحهم المجلس الاستشاري الأعلى ولو من احدهم لفترة مؤقتة تنتهي بنهاية ولايه الرئيس و الدعوة لانتخابات رئاسية جديدة للرئيس ولتعين نائبا له.

7-   الغاء قانون الطوارئ ووقف العمل به فورا و حل و الغاء جهاز الأمن المركزي و احالة العاملين فية الى وحدات الجيش للانخراط في خدمة الوطن من خلالة و كذلك تقليص و تخفيض العاملين في المخابرات الامنية و السياسية الى النصف فقط  50% واحالتهم  للخدمات العامة و الوظائف المتاحة في القطاع العام بمشاركة من القطاع الخاص في ذلك قدر الامكان.

8 ـ    التأكيد على حيادية الجيش في النزاع السياسي الطارئ وإذا دعت الضرورة لتدخله فيكون لصالح  الشعب ولا يمكن أن يستغل ضد الشعب أو بإيذائه بأي صورة .

الاستجابة للشعب ….. و التاريخ خير شاهد:

اذن هي استجابة للمطالب الشعبية وإنحناء أمام عاصفة شعبية وهو الحكمة في مثل هذه الظروف يواكبه موقف شعبي لا تنقصه الحكمة أيضا وشيء من تقدير الموقف فيه مع ما تقدم من ضمانات واستجابة للمطالب تقابلة شيئ من التخفيف من حدة المطالب التي أن جاءت بصورة عفوية مؤلمة جارحة أحيانا في التعبير عنها في الشارع كرد فعل لالام الشعب و جراحة فإنه لا يجوز بحال أن يعبر عنها بذات الشدة و الايلام في اتفاق سلمي يعقد  مع من ظل لعقود مضت رمزاً على رأس السلطة وهو اليوم يدعي ليبقى على هذه الرمزية في إطار ما تقدم ولعله قد يرى فيما حدث ويحدث انتقاصا لمكانته وما تمتع به من رمزية على طوال سنين مضت ولكن سوف يسجل له التاريخ وترصد له الضمائر الحية موقفا لصالح شعبه ووطنه وفي تاريخ مصر رصيد للتنازل الحر السلمي عن العروش و المناصب مهما اختلفت المسميات وفق الانظمة فهو تنازل عن السلطات وانتقال بالمحروسة فليكن اليوم انتقال ايضا لاحضان المحروسة و شعب المحروسة … .

ونحن في أمس الحاجة لمبادرات كهذه تقوم على التضحية والتنازل والبذل وما لم يحصل شيئ من ذلك فإن البلاد مقدمة على المزيد مما جرى ويجري ومرشحه للتفاعل والخروج عن نطاق الفهم والتفاهم والسيطرة أو الى ما لا تحمد عقباه لا قدر الله .

لذلك تقدمنا بما سلف من موقعنا رغم بعد المسافات لكن تقارب القلوب والأرواح في عالم واحد وأمة واحدة ومصير واحد أملى علينا النصح والكلمة المخلصة لله و الرسول لأمة المسلمين و عامتهم  .

فإن صحت و قبلت فمن الله والحمد لله .

وإن كانت غير ذلك فاقبلوا عذري واعتذاري وحبي ووفائي لمصر وأمتي ..

حفظ الله مصر للأمة وحفظ الأمة بمصر ، والله من وراء القصد ..

مقدمة : للمحكمة الأوروبية لحقوق الإنسان

مقدمها : الأستاذ المحامي / مبارك سعدون المطوع

من دولة الكويت

بوصفه أحد المتضررين والمصابين المعتقلين من ركاب سفينة مرمرة الزرقاء ـ الذين هاجمهم قوات الاحتلال الإسرائيلية في المياه الدولية وقد أعتقل وأهين وسجن في بئر السبع .

وبصفته التي كان يمثلها في سفره على السفينة كنائب لرئيس اتحاد المنظمات الأهلية في العالم الإسلامي .

حيث أنه وفي بداية شهر مايو 2010 أبلغ بصفته نائب رئيس اتحاد المنظمات الأهلية في العالم الإسلامي وأخطر الاتحاد ان المنظمة الإنسانية الملقبة بـ I.H.H …. تقوم بإعداد وتحضير عدة سفن بعضها محمل بالمواد والمساعدات الإنسانية والإغاثية وبعضها سيحمل ركابا وأشخاص من كافة دول العالم للتوجه إلى موانئ قطاع غزة في فلسطين متطلقه من أحد موانئ تركيا وسيضم إليها عدد من السفن من دول أخرى .

وذلك بغرض إيصال المساعدات الإنسانية والمشاركة في التخفيف من معاناة السكان في غزة والعمل على إنهاء الحصار الظالم للقطاع .

وحيث أنه بلغه أن القوات الإسرائيلية وسلطة الاحتلال قد أعلنت أنسحابها من القطاع منذ سنوات وفرغت المستوطنات التي كانت داخل نطاق القطاع وبذلك يكون القطاع محررا ولايوجد ثمة ما يمنع من دخوله من طريق البحر حيث أن  الطرق البرية جميعها مغلقة ومحاطة بمعابر إسرائيلية أو عربية مغلقة .

الأمر الذي أدى إلى معاناة  القطاع وأهاليه معاناة إنسانية شديدة تحت التجويع والإذلال وفرض الحاجة المتعمد وقد تخلل هذا الحصار هجمات شرسة بالسلاح وعدوان متكرر من آن لآخر على أجزاء متفرقة من القطاع كان يؤدي في كل مرة إلى سقوط الضحايا من القتلى والجرحى وهم من المدنيين والأبرياء العزل .

وكان أخطرهم هجوم وقع وعدوان وحشي لا إنساني سافر ذلك  الذي حدث في 27/12/2008 واستمر زهاء 22 يوما حتى يوم 19/1/2009 يوم الإعلان عن وقف العمليات القتالية والتي سميت بالرصاص المصوب .

والذي أدى غلى آلاف القتلى وبد بلغ عددهم ما يقارب 1450 قتيل من الأطفال والنساء والرجال والعجزة كما تسبب في جرح وإعاقة الآلاف من الناس أيضا وتشريد الآلاف وتدمير البنى التحتية والمساكن والمدارس والمساجد والمزارع في القطاع مع استمرار إغلاق المعابر المقصود للتوصل للاستسلام سياسيا وإملاء الشروط وتغير وجه الإدارة في القطاع .

الأمر الذي زاد من حدة وشدة الحصار على القطاع وأبقى الناس بلا مأوى وبلا مساكن وبلا مقومات الحياة الإساسية التي يسأل عنها المجتمع الدولي كما تسأل عنها بالدرجة الأولى من تسبب فيها .

ومن يمارس الحصار فعليا على القطاع وأهله كما أنه تعد انتهاكا لأبسط حقوق الإنسان وخرقاً لاتفاقيات جنيف الأربع .

وأنه جاء نتيجة مؤامرات سياسية وتواطئ من عدة جهات الأمر  الذي يستوجب محاسبتها جميعا من الناحية القانونية سوءا من كان فعله في العلن وأن من كان يمارسه خفيه ثم أكتشف أمره واتضح لاحقا.

وأن هذه المعاناة لشعب يتراوح عدده نحو مليون ونصف نسمة من رجالا واطفالا ونساء قد تزايدت بشكل واضح في السنوات الأخيرة وخاصة بعد العدوان والحرب والمشار إليها .

الأمر الذي دفع بكثير من النشطاء ومحبي السلام والغيورين على الحقوق الإنسانية والداعين لها والمتمسكين بحق الإنسان في الحياة وبحق الشعوب في تقرير مصيرها ونيل حقوقها كاملة من أولئك جميعا ومن بينهم المدعي بتشكيل فرق من العديد من الدول وتوافقوا جميعا على المشاركة في قافلة بحرية وتشكيل عدة سفن لتحمل المعونة وتحمل المشاركين في قافلة بحرية وتشكيل عدة سفن لتحمل المعونة وتحمل المشاركين للإعراب عن حقيقة ما يجري والتحقق من العدوان الإسرائيلي بالانسحاب من قطاع غزة وعدم احتلاله ، الأمر الذي يستوجب فتح المعابر وحرية تنقل الناس ودخول السفن إليه من البحر ولهذا الغرض تحركت هذه السفن من ميناء إنطاليا بتركيا مساء يوم 24/5/2010 وتوجهت نحو بحر قبرص ومنه إلى غزة يوم 30/5/2010 وعلى متنها ما يقارب 800 مشارك رجالا ونساء وعاملين ، وحيث أن الشاكي كان من بينهم وكان الحصار قد فرض على غزة منذ سنوات وظهر في أوجه وشدته بعد الحرب وقد ثبت بكل يقين أن ثمة أطراف ضالعة في فرض هذا الحصار سواء بقوتها أو بفعلها أوبالمشاركة فيه أو في فرضه والعمل لمصلحتها وكلها جميعا شريكة في جريمة الحصار وما ترتب عليها من أعمال وتداعيات ومواجهات منها ما الاثنين 31/5/2010 حيث مع الساعات الأولى منه بعد منتصف الليل بدأت السفن الحريبية والقوارب الإسرائيلية تلاحق السفن وقبيل الفجر حاصرتها عن قرب بمعاونة واشتراك طائرات مروحية أقتربت من السفن وبدأت بإطلاق النار والرصاص الحي القاتل والمطاطي وقذائف الغازات وتعرض الشاكي إلى هذه القذائف واحتمى بأجزاء من السفينة وتواجه القوات الكوماندوز بعدد من ركاب السفينة في أعلاها وهم تحت وابل من القذائف والنيران الحية لاخلاء المنطقة المنزل إليها الجنود مما تسبب في قتل 9 شهداء وعشرات المصابين والجرحى بجروح خطيرة في خلال دقائق معدودة مما أدى غلى السيطرة التامة على السفينة ومن فيها بأقل من ساعة .

وكان من المعلوم للشاكي ومن معه وهم عزل لا يحملون أي أداة أو أسلحة أنهم يذهبون في مهمة سلمية وإنسانية بقصد الإغاثة ومعرفة أحوال القطاع وخاصة ما يقال عنه أنه ليس تحت الاحتلال بعد الانسحاب منه وانه يدار بطريقة حرة وبمعرفة سلطاته ، لكن ما حدث يوم 31/5/2010 للشاكي ومن كان معه على  السفينة أثبت غير ذلك .

بل أنه يعد من قبيل القرصنة الدولية أو الاعتداء على السفن والأرواح والركاب في المياه الدولية عندما يثبت للكافة أن السفينة مرمرة كانت على بعد 98 كيلوا في عرض البحر بعيدة عن الشواطئ.

وأن الاعتداد عليها وعلى ركابها ومن بينهم الشاكي يعتبر اختراقاً لكل القوانين الدولية وانتهاكاً صارخا لكل الأعراف الدولية ، وهي محل تحقيق من عدة لجان دولية ومحلية .

إلا أن ذلك كله وهو مرتبط بأصل  الحصار المفروض على القطاع ومرتبط بالعدوان الوحشي السافر اللانساني الواقع في 27/12/2008 والذي استمر بطريق الحصار المشدد والتجويع والإذلال والإهانة والحرمان من مقاومات الحياة التي دعت جميعا لتحريك هذه السفن والحملة العربية لمواجهة هذا الحصار والتي اشترك فيها الشاكي .

وقد تبين أن كل من كان وراء هذا الحصار أو العدوان وشن الحرب على غزة وبشكل متكرر عبر سوات أو تلك التي استمرت 22 يوما من 27/12/2008 حتى 19/1/2009 فإنهم جميعا مجرمون وفقا للقوانين الدولية والأعراف والمعاهدات وأن ما نصت عليه  المواد الأولية من اتفاقية روما للنظام الأساسي للمحكمة الجنائية الدولية I.C.C لتشمل هذه الأفعال . وإضافة إلى المدعي عليهم من قيادة  القوات والحكومة الإسرائيلية وهذا معروف ومكشوف للكافة إلا أنه مما يؤسف له أن ثمة مهتمين من العرب والفلسطينيين المتخفين بأثواب الوطنية أو المناصب الفلسطينية لكن ذلك لايعفيهم من المسئولية وضرورة إجراء التحقيق معهم وتوجيه الاتهام لهم ومن بينهم بل على رأس القائمة المدعو / محمود ميرزا عباس (الشهير بأبو مازن) .

والمدعو ـ محمد دحلان ـ وآخرين :

بعد أن ثبت بالدليل القاطع تورطهم ومن سيكشف عنهم التحقيق الواجب اجراؤه منهم قد تآمروا وتعاونوا بطريقة الاشتراك الجنائي المعمول به في جميع القواعد العامة الجنائية بطريق التحريض والتآمر لدعم المعلوماتي واللوجستي بل أنهم كانوا يتحركون في الخفاء مع العدو الظاهر في العدوان على غزة وضربها وإبادة أهلها وتدمير بنيتها ومساكنها وذلك كله لأجلهم ولصالحهم في سبيل إسقاط الجماعة التي تدير شئون غزة ولخلاف سابق معهم على  التحكم في  القطاع وتمرير الاتفاقات باسم الفلسطينيين مع من يقتلهم ويعاديهم من الاسرائليين وقد برز هذا الدليل القاطع المشار إليه بتصريحات صريحة للمسئولين الإسرائيليين وبالمقابلات التي كان يجريها مسئولي السلطة الفلسطينية وأولهم المتهم الأول .

والتنازلات التي تقدم من وقت لآخر رغم كل هذه الاعتداءات وسنقدم هذه الاعترافات محررة ومكتوبة ومسجلة لهؤلاء المسئولين كأدلة لا تقبل الشك .

الأمر الذي يستوجب محاكمة جميع من كان وراء الحصار على غزة وجميع من شن الحرب وقام بالعدوان على أهل القطاع وأدى غلى تردي أوضاعه وإنهيار بنيته وإذلال الناس غلى حد التجويع والسكن في العراء وهذا إهانة للإنسانية لم يقبلها الشاكي ولا المشاركين معه في سفن الحرية التي اتجهت وانطلقت من تركيا يوم 24/5/2010 الماضي وتم الاعتداء عليها يوم 31/5/2010 .

وحيث أن المشكو بحقهم جميعا كانوا وراء ذلك وهم المتسببين المباشرين وغير المباشرين من كان ظاهرا منهم أو متخفيا تحت أي مسمى أو شعار لكن ذلك لا يمنع من إظهار الحق وإحقاق العدالة وفقا لهذه الشكوى ، وطبقا لاختصاصات محكمتكم الموقرة من أقوال وأدلة وشهود وإثباتات بعد إحالة الدعوى للمحاكمة .

ملتمسا بصفة مؤقتة ومستعجلة الحكم بعدم أحقية أو صفة أي منهم في ممارسة أي دور أو عمل يتصل بموضوع الدعوى وبمصير القطاع وأهله والفلسطينيين عامة وإلى حين استجلاء الحقائق والبت في الدعوى .

STATEMENT OF FACTS
The Applicant, Mr. Mubarak AL Mutawa a Kuwaiti National Lawyer is represented before the Court by a Law Firm Based in Washington D.C. USA.
A. The circumstances of the case
The facts of the case as submitted by the applicants and as summarized as follows:
1. The Plaintiff hereby files this complaint in his capacity as one of those who incurred damages, injured and arrested people from among the passengers of the ship MV Marmara who were attacked by the Israeli occupying forces in the international waters where he was detained, arrested, humiliated at Ber Al-Sabie. Also in his capacity, while he was on board the ship, as representative and as one of the Officials of the Civil Popular Organization Union in Islamic World.

In the beginning of May, 2010, Mr. Mubarak Al Mutawa was notified in his capacity as a one of the Officials of Civil Popular Organization Union in Islamic World, the Union that the I.H.H. Organization is preparing several ships, some of them will carry goods and humanitarian aid and some will carry passengers and persons from many countries of the world in order to go to the ports of Ghaza Strip in Palestine or any other nearly ports if it is not possible or not allowed to do so which will be launched from a Turkish port and some ships from other countries of providing the necessary humanitarian and to participate in alleviating the suffering of the Palestinian people in Gaza and working for putting an end to the unjust blockage of Gaza.

Whereas he came to know that the Israeli forces and its occupation authorities had declared its withdraw from Gaza for several years and vacated the Israeli settlements which were built within the territories of Gaza Strip, and therefore the Strip should be deemed as a free land and there is no preventive obstacle that obstruct anyone to have access to it by the sea because all land roads are closed and surrounded with Israeli or closed Arab gateways.

This tight blockage caused a lot of suffering to the Gaza Strip and its dwellers an unprecedented humanitarian suffering under strict starvation and humiliation and intentional deprivation of the least basis and necessities of human life. This blockage has always been accompanied with frequently repeated brutal attacks by using uncontrolled armed forces and also repeated aggressive raids from time to time against the different parts of Gaza strip, the thing that used to result in every attack in fatal cases of dead and badly injured people from among the innocent civilians.

The most dangerous and brutal attacks launched by the occupying forces against Gaza in an expressly un-humanitarian way was the attack that took place on 27.12.2008 which was continued for about 22 days up to 19.01.2009, the day in which the ceasefire was declared and the military hostilities were stopped in an unprecedented military operation which the Israeli forces called “The Cast Bullets Operation”.

This brutal aggression had caused the death of more than 1450 cases of the dead from children, women and the elderly in addition to the fatal injuries to several thousand as well as the displacement of tens of thousands due to the damage and
destruction of their houses by the Israeli forces besides the gross damages to the basic infrastructure in Gaza like schools, houses, mosques, farms together with the continuous and intentional closure of all border cross points in order to compel the people of Gaza to political surrender and raise the white banner and therefore the Israeli occupying powers can then dictate their conditions and change the managing authority in Gaza.

The Israelis failed to achieve this political goal because the people of Gaza had courageously defended their land and integrity. Accordingly, the Israelis has tightened the blockage of Gaza and left thousands of people homeless after the destruction of their houses as well as depriving them from the simplest basics of life which the international community is held responsible for that and in the first place the responsible party is the one who caused this kind of inhuman life because it is the authority that actually practices the blockage measures against the strip and its people, and this is deemed as a violation and gross breach to the least human rights as well as a breach of Geneva fourth agreement.

This tight and strict blockage came as a result of political conspiracies and collusion by several parties who should all of them be held legally accountable, whether those who practice their acts openly or those who acted secretly but thereafter their acts are revealed and betrayed.

This severe and hard suffering by the people of Gaza whose total number is about one and a half million population including men, women and children has been obviously increasing during the last years, particularly after the recent aggression and brutal war which we explained hereinabove.

This kind of irresponsible behavior made many activists and those who are quite keen and serious to protect the human rights and those who strictly adhere to the right of man in a dignified life and the right of people to decide their own destiny and get their full rights, all the above mentioned people, including the plaintiff, have formed teams from several countries and they mutually agreed and planned together to participate in a marine convoy consisted of a number of ships in order to carry humanitarian aids as well as the participants so as to express their attitudes towards the real facts which are going on and to verify the Israeli aggression who allege that they withdrew from Gaza and not occupying it.

This Marine Convoy aims at opening the border centers and gives the people free movement from and to Gaza from the Sea. For this purpose, the above ships commenced their journey from the port of Antarctica in Turkey in the evening of 24.5.2010 towards Cyprus Sea and from there to Gaza on 30.5.2010. There were more than 800 participants on board the ships, men and women.

. The plaintiff was among those participants, and whereas the blockage has been imposed against Gaza several years ago, and it is being tightened and increased after the recent war; and sine it is evidently proven that are certain parties involved in the imposition of this blockage, whether through their power or acts or by contributing to it in order to achieve personal gains; and whereas all those who are involved in the crime of this blockage and the consequences and damaging effects resulting thereof, among which the incident that took place on Monday 31.5.2010 when in the early hours of this day immediately after midnight when the warships and Israeli boats began to pursue the humanitarian aid ships. Before dawn, they came close to the ships and made a seize around them by the assistance and effective participation by the Israeli Helicopters that remained hovering above the ships in close proximity and suddenly they begin to shoot fire against the humanitarian ships using fatal shots and bullets in addition to the rubber shots and gases.

. The plaintiff had personally suffered from this attack and the direct shooting but he managed to protect himself by going to some parts of the ship. The Israeli commandoes when they landed on the top of the ship they were faced by the unarmed passengers who suffered from the extensive shooting by the armed forces who were trying to force them to leave the area where they landed.

. This attack caused the death of a person’s martyrs and tens of injured participants who incurred fatal injuries within few minutes, and the Israeli aggressors finally controlled the ship within less than an hour. It was understood in the past by the complainant and his companions, who are civilian people and not carrying any weapons or harmful tools, that they are going in an official and humanitarian task for the purpose of providing aids and become informed of the conditions in Gaza, especially it always been said that Gaza is not under occupation after the Israeli withdraw from it, and that it is being managed under the free will of its local authorities. However, what happened on 31.05.201 to the complainant and his colleagues on board the humanitarian aid ship proved the contrary.

. Rather, these kind of acts can be deemed as international piracy acts or an attack against the ship an its passengers while they were in the territorial waters; and the investigation will confirm to all the public worldwide that the ship (Marmara) was at 98 Kilometers far from Gaza coast in the middle of the sea.

. Accordingly, the attack against the ship and its passengers, among who is the complainant, is an express and obvious breach to all international laws and an express violation to all the international norms & principles, and the case is now under investigation by several local and international committees. However, all what has happened and still taking place is connected directly to the original issue of the blockage imposed on Gaza and resulting from the brutal, arrogant and un-human aggression that occurred against Gaza on 27.12.2008 that continued until now through the tight & strict blockage, starvation, humiliation, degradation and deprivation of the basic needs of life that called upon the organization of these ships in addition to the Arab campaign for facing this blockage in which the complainant participates.

. It becomes clearly evident that everyone who stood behind the imposition of this unjust blockage or the brutal aggression and the repeated wars launched against Gaza for many years the most recent of which is the savage & barbaric war that lasted for 22 days continuously from 27.12.2008 up to 19.01.2009, all those participant in the said war are criminals according to the international laws, norms and conventions because the primary articles of Rome Agreement that govern the Articles of Association of the International Criminal Court (I.C.C.) include these acts. In addition to the prosecuted persons from the Israeli army commanders and the leaders of the Israeli government, which is evident and well known to all, but it is regretfully important to mention that there are other charged persons from the Arabs and Palestinians who are hidden and dressed in the national uniform or occupying Palestinian official seats, but this will not exempt them.

. from being accountable and the necessity of making them subject to investigations and thereafter charged for their acts, among those but the leader of those persons is the so-called / Mahmoud Merza Abbas (nicknamed as Abu Mazin), and the so-called/Mohammad Dahlan and other.

. It is evidently and clear-cut proven that they are involved in these acts and the investigations to be conducted with them will reveal that they have been continuously in collusion and cooperation through criminal participation method which is applicable in all the general Criminal rules when they encouraged and contributed to the conspiracy by the logistic support and provision of information. Furthermore, they were acting secretly with the express enemy in the aggression against Gaza aiming at attacking Gaza violently and aggressively and then destroy Gaza’s people and its infrastructure and houses, schools, farms and everything, all that in order to achieve their personal interests for the purpose of overthrowing the governing group in Gaza who run the affairs of the Gaza Strip due to the previous conflict that took place between them regarding who controls the Strip.

. Also, they are trying to sign unfair agreements in the name of the Palestinian people with those who are killing them from the Israelis. This clear-cut and conclusive evidence referred to hereinabove is represented by the express statements made by the Israeli officials and the interviews made buy the officials and the interviews made by the officials of the Palestinian Authority, at the beginning of them is the first accused as well as the concessions waived by them from time to time to the enemy despite all the attacks and aggressive raids. We will provide these confessions in written and recorded forms which show the involvement of those officials as un- doubtful evidences.

. Consequently, all those who were behind the unfair blockage against Gaza, and all those who launched the war and aggression against the people of Gaza and caused the deterioration of the situations in Gaza as well as the collapse of its infrastructure, humiliation of its people to the extent of starvation and leaving them to stay in the open squares after the damage of their houses, all those persons should be brought before the court so as to be accountable for their committed acts, because such kinds of behaviors are a sort of degradation, a humiliation, and insult for the whole humanity which is not acceptable for the complainant and his companions in the ships of freedom that started from Turkey on 24.5.2010 and was attacked by the Israeli forces on 31.5.2010.

. Whereas all the complained of persons were behind those incidents and they directly or indirectly caused those incidents, whether those who were obviously and openly practicing their acts or hidden under any designations or slogans but that will not prevent the revealing of the real facts and application of justice under this complaint and according to the jurisdictions of your respectable court which will peruse the statements, evidences and witnesses of proof upon referring the case to the court for trial.

. Therefore, the plaintiff hereby demands your respectable court, in a prompt summary and provisional judgment which rules that neither of the abovementioned officials of the Palestinian Authority has the capacity or right to practice any role or act related to the subject matter of the case and the destiny of Gaza, its people and all Palestinians until the reveal of the facts and finally deciding on this case.
